Sculpture IS – Loan Agreement

I will loan PVA artwork and/or other items for the exhibit listed above, during the dates listed above. The specific items to be loaned are listed on this form below. All artwork will be new to PVA (i.e.: not previously exhibited at the Sierra Azul Nursery and Gardens, some exceptions may apply).

DELIVERY: I will deliver the artwork(s) to Sierra Azul Nursery and Gardens on my specified appointment date/time. Insurance begins upon delivery and installation.

PICKUP: I will pick up the item(s) on MY SPECIFIED APPOINTMENT DATE/TIME, DURING THE FIRST WEEK IN NOVEMBER, 2026. Items will only be released to the lender or an agent designated in writing and only during the scheduled pick up time. Sold items are released to buyers upon completion of purchase. Artists must verify completion of delivery/installation.

PVA will charge $10/day storage fee on any item remaining in the garden after the pickup deadline passes, unless prior agreement has been made with Sierra Azul. Items left by the artist 30 days after the deadline, become the property of PVA and may be sold to benefit the organization.

Conditions of acceptance will be determined at the discretion of PVA and PVA reserves the right to refuse artwork that it deems structurally not ready for display for any reason. Items must be delivered in good condition, with no loose or broken parts or raw edges that are not part of the artwork itself. All 3-D work must be stable and all elements securely attached. PVA reserves the right to not accept or exhibit items that do not meet these criteria or have other unfinished and/or potentially hazardous conditions.
a. PVA will provide installation/removal equipment at the Sierra Azul site, appropriate to installation instructions as provided on entry form.
b. The lender must take reasonable care to secure the installed item by coordinating with PVA and Sierra Azul. ONGOING MAINTENANCE AFTER INSTALLATION IS THE RESPONSIBILITY OF THE ARTIST.
c. Artist may be asked to install, or supervise the installation of work. There may be size and weight limitations. Any pedestals or cases provided by the artist must also meet safety criteria and must sit firmly and securely in place at the garden.
d. All artwork delivered must match the descriptions provided by the artist. Please do not substitute artworks.
e. All items will be delivered and removed at the designated appointment time. Work may not be removed from the exhibit prior to the designated appointment dates unless: the piece is sold and delivered prior to the closing dates, or the piece requires removal to be repaired in case of failure of the piece due to process of construction or media.

There will be a $35 one-time per year participation fee for those artists selected into the exhibit. Participation fee may be waived for collaborative entries submitted by schools or non-profits. This exhibit is coordinated primarily through a volunteer effort and funded by grants and sponsorship. Participating artists are encouraged to volunteer.

All artwork must be for sale. PVA will retain a commission on all items sold during the exhibit, 30% for PVA members, 45% for nonmembers at the time of the sale. For membership information go to pvarts.org/membership

The artist sets the price. PVA does not negotiate with buyers, alter the artwork, or sell portions of multi-unit pieces, without the express permission of the artist. Artist understands that the price set for item does not include delivery and installation with the buyer, and that artist may be required to negotiate delivery and installation of piece(s) that are sold during the exhibit. Buyer may pick up purchased artwork AFTER the opening reception. PVA collects payment at the time of sale. A check for payment to the artist will be mailed by the first of the month following verification of delivery/installation of the piece(s). PVA does not ship artwork.

I agree to allow PVA to publish digital images provided by me for the purposes of press releases and marketing, at their discretion. PVA accepts JPG or TIFF format, at 300 dpi resolution or better, any size. I also agree to allow PVA to capture images of any work featured in the garden and to publish at their discretion, including releasing such images to media outlets for the purpose of press releases and marketing and PVA’s website and exhibit literature.

I understand that all artwork described in the following sections is covered by this agreement and subject to the terms outlined in the “Artist Loan Agreement.” I reserve the right to withdraw any submission if done so PRIOR to installation. I agree not to remove any artwork before the designated pick-up date and time. Additionally, I consent to PVA publishing my name and details about the artwork submitted. All work to be submitted is specifically described in the following page(s), and all works described on the following page(s) are covered by this agreement.
